Welcome to Hush Air. These Terms of Service govern your use of our website and purchases made through our online store.
The website and online store are operated by Hush Air (Pty) Ltd (“Hush Air”, “we”, “us” or “our”). By accessing our website, creating an order or purchasing a product from us, you agree to these Terms of Service.
1. AGE RESTRICTION
Hush Air products containing nicotine are intended exclusively for adults aged 18 years and older.
By accessing age-restricted areas of our website or purchasing an age-restricted product, you confirm that you are at least 18 years old and legally permitted to purchase the product.
We reserve the right to request reasonable proof of age before processing, dispatching or handing over an age-restricted order. Where appropriate, our delivery or fulfilment partners may also require age verification.
Providing false or misleading age information may result in an order being refused or cancelled.
Nicotine is addictive. Hush Air products containing nicotine are intended for adult nicotine users only.
2. OUR PRODUCTS
Hush Air sells vaping products, including products incorporating a phone-case design.
Product specifications, nicotine strength, flavour, compatibility and other important information are displayed on the applicable product page.
Customers are responsible for selecting the correct phone model or compatibility option before completing an order.
Product images are intended to represent our products as accurately as reasonably possible. Minor differences in appearance, colour or packaging may occur.
3. NICOTINE INFORMATION
Products advertised as containing 5% nicotine (50mg/ml) contain nicotine at the strength stated on the applicable product page.
Nicotine is addictive. Customers should read the product information and warnings before purchasing or using a nicotine-containing product.
Hush Air products are not medicines, smoking-cessation products or medical devices and should not be treated as such unless expressly stated otherwise.
4. ORDERS
Placing an order through our website constitutes an offer to purchase the selected products.
An order is not necessarily accepted merely because payment has been submitted or an automated order confirmation has been generated.
We may refuse or cancel an order where reasonably necessary, including where there is suspected fraud, an obvious pricing or stock error, incorrect customer information, inability to verify age where required, or another legitimate reason preventing fulfilment.
If we cancel an order after receiving payment and the customer is entitled to a refund, the relevant amount will be refunded using an appropriate payment method.
5. PRICES AND PRICING ERRORS
All prices are displayed in South African Rand (ZAR) unless otherwise stated.
We make reasonable efforts to ensure that prices displayed on our website are accurate.
Where an obvious pricing or technical error occurs, we reserve the right, subject to applicable law, to correct the error and contact the customer before fulfilling the affected order.
Nothing in this section limits any rights a consumer has under applicable South African law.
6. PAYMENT
Orders must be paid using one of the payment methods made available at checkout.
Payments may be processed by third-party payment service providers. Their own terms, security measures and privacy practices may apply when their services are used.
Hush Air does not guarantee that every payment method will be available for every transaction.
7. DELIVERY
Our standard estimated delivery timeframe is 7–10 business days, unless a different timeframe is displayed or communicated for a particular product or order.
Delivery estimates begin once an order has been successfully processed and may be affected by weekends, public holidays, courier delays, address problems, exceptional demand or circumstances outside our reasonable control.
Customers are responsible for supplying accurate delivery information.
We will make reasonable efforts to communicate material delays that become known to us.

8. RETURNS, REFUNDS AND DEFECTIVE PRODUCTS
Returns, refunds and exchanges are handled in accordance with our Returns & Refunds Policy and applicable South African consumer law.
Nothing in these Terms is intended to exclude, restrict or waive any consumer right that cannot lawfully be excluded or restricted.
Where goods are defective, unsafe or otherwise fail to meet applicable statutory requirements, the customer’s remedies will be determined in accordance with applicable South African law.
Due to the nature of certain vaping products, hygiene and safety considerations may affect whether an opened or used non-defective product can be returned, to the extent permitted by law.
Please contact Hush Air as soon as reasonably possible if you receive an incorrect, damaged or defective product.
9. CANCELLATIONS
Order cancellations will be dealt with in accordance with applicable law and our Returns & Refunds Policy.
If an order has already entered fulfilment or been dispatched, different return procedures may apply.
Nothing in this section limits any statutory cancellation or cooling-off right that applies to a particular transaction.
10. PRODUCT USE
Products must be used responsibly and in accordance with the instructions and warnings supplied with the product.
Customers should not modify, puncture, expose to excessive heat, deliberately damage or otherwise misuse batteries or vaping devices.
Hush Air is not responsible for loss or damage caused by misuse, unauthorised modification or use contrary to product instructions, except where liability cannot lawfully be excluded.
11. PHONE COMPATIBILITY
Where a Hush Air product is designed for a particular phone model, the customer must select the correct compatible model when ordering.
Customers should verify their phone model before completing checkout.
Selecting an incorrect model does not affect any statutory rights that may otherwise apply, but it may affect whether an ordinary change-of-mind return or exchange is available under our Returns & Refunds Policy.
12. WEBSITE INFORMATION
We take reasonable steps to keep information on our website accurate and current. However, occasional typographical, technical, stock or pricing errors may occur.
We may update website content, product information and availability where reasonably necessary.
13. INTELLECTUAL PROPERTY
Unless otherwise stated, the Hush Air name, branding, website design, original graphics, photographs, written content and other original material belonging to Hush Air may not be copied, reproduced, distributed or commercially exploited without permission.
Third-party trademarks and intellectual property remain the property of their respective owners.
14. PROHIBITED USE
You may not use our website for unlawful or fraudulent purposes, interfere with the operation or security of the website, attempt unauthorised access to systems or accounts, submit false information, impersonate another person, or purchase age-restricted products on behalf of a person who is not legally permitted to purchase them.
15. THIRD-PARTY SERVICES
Our website may use third-party services including Shopify, payment processors, analytics providers and delivery companies.
Certain aspects of your transaction may therefore also be subject to the applicable third party’s terms and privacy practices.
16. PRIVACY
Personal information collected through our website is processed in accordance with our Privacy Policy and applicable South African data-protection requirements.

17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Hush Air will not be liable for indirect or consequential loss arising solely from improper use of a product, unauthorised modification, failure to follow supplied instructions or circumstances outside our reasonable control.
This provision does not exclude or limit liability or consumer rights where doing so would be prohibited by South African law.
18. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, website, products or applicable requirements.
The version applicable to an order will generally be the version in effect when that order was placed, subject to applicable law.
19. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa.
Nothing in these Terms prevents a consumer from exercising rights or pursuing remedies available under applicable South African consumer-protection legislation.
